Public Procurement
All construction related projects involving public expenditure must conform to Department of Finance Public Procurement Procedures. These procedures state that contracting firms including subcontractors must be compliant to all statutory legislation including Registered Employment Agreements when engaged on public works contract thereby creating a level playing field for competing tenderers. Example list of awarding bodies :- Local Authorities, County Councils, District Councils, Health Boards, Vocational Educational Colleges, Government Departments, Office of Public Works, National Roads Authority, Electricity Supply Board etc (list not exhaustive)
Extract - section 5.3.2
“The Contractor shall ensure that the rates of pay and conditions of employment (including in relation to pension contribution) of each work person comply with all applicable law, and that those rates and conditions are no less favourable than those for the relevant category of work person in any employment agreement registered under the Industrial Relations Act 1946-2004”.

Under the Craft Analog Agreement, Local Authorities are required to ensure that all assigned contractors are compliant to all statutory requirements.
Letters of ComplianceLetters of Compliance (LoC’s) are issued by the Construction Workers Pension Scheme (CWPS) to certify that the named employer is up to date and in compliance to the Registered Employment Agreement (Construction Industry Pensions Assurance & Sick Pay). LoC’s are site specific and include a security hologram identifier for security purposes. LoC’s can be requested from CWPS on 01- 4977663.
Alternative Pensions, Assurance and Sick Pay scheme providers must be required to provide their client (i.e. contractor) with a statement from their Provider (not broker) stating their scheme is in full compliance to the provisions as specified in the Registered Employment Agreement (Construction Industry Pensions Assurance & Sick Pay).
